Legal process of validating a will

Understanding What Probate Is

Probate is the court process of proving a deceased person’s will. It confirms the will is valid and gives the executor authority to collect and distribute the estate. Without a grant, banks and registries may refuse to release assets — even if the will is genuine.

Applying for Probate

The executor named in the will applies through the Supreme Court of the State or Territory where the deceased lived. WillCloud can hold the will and related papers so that application is based on a complete file. We do not lodge the application for you.

Steps in applying for probate

Simplify estate management

Administering and Distributing the Estate

After a grant, the executor collects assets, pays debts and tax, then distributes what remains. Records and transparency matter. WillCloud is built to keep that file in one place so the job is more straightforward.

Parties involved in probate

The executor manages the estate and carries out the will.

Beneficiaries inherit under the will.

The Supreme Court grants probate and oversees validity. The Court is not a user of WillCloud.

Solicitors prepare and lodge applications where you instruct them.

Creditors must be paid before distribution.

Banks, super funds, share registries, and land titles offices release assets once they have the grant they require.

A public trustee may act if no executor can.
